1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and MathMigo LLC, a California limited liability company ("MathMigo", "we", "us", or "our"). By creating an account, downloading our app, or using our service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use MathMigo.

You must be at least 18 years old and a parent or legal guardian to create an account. By creating an account and adding student profiles, you represent that you have the legal authority to agree to these Terms on behalf of yourself and any children whose profiles you create.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Description of Service

MathMigo provides: (a) personalized math practice worksheets for children ages 3-12, (b) AI-powered grading of worksheet photos, (c) progress tracking and learning analytics, and (d) curriculum recommendations based on skill level.

MathMigo is a supplemental educational tool designed to support math learning. It is not a replacement for classroom instruction, tutoring, or professional educational services. We do not guarantee specific educational outcomes, grade improvements, or test score increases.

Our AI grading system analyzes photos of completed worksheets to score answers. Grading accuracy depends on photo quality, lighting, handwriting legibility, and other factors. The AI may occasionally make errors. Parents should review graded worksheets and contact support if they believe an error occurred.

We may modify, suspend, or discontinue any aspect of the service at any time. We will provide reasonable notice of material changes that affect your subscription.

3. Subscriptions, Billing & Cancellation

Free Trial: New users may be eligible for a 7-day free trial. Trial eligibility is determined at our discretion. You may only use one free trial per household.

Subscription Plans: Single Student plan ($20/month or $200/year) includes one student profile. Family plan ($40/month or $400/year) includes up to four student profiles. Prices are in US dollars and may vary by region.

Billing: Subscriptions are billed through the Apple App Store. By subscribing, you also agree to Apple's terms of service. Your payment method will be charged at the beginning of each billing period.

Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage subscriptions and turn off auto-renewal in your Apple ID account settings.

Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of your current billing period. You will retain access until then.

Refunds: Refund requests are handled by Apple according to their refund policies. We do not process refunds directly. Printed worksheets remain yours to use regardless of subscription status.

Price Changes: We may change subscription prices with at least 30 days advance notice via email. Price changes apply to subsequent billing periods, not your current period. You may cancel if you do not agree to a price change.

4. Acceptable Use

You agree to use MathMigo only for its intended purpose: providing math practice for children in your household.

You may: Print worksheets for personal, non-commercial household use. Share your account access with other adults in your household who help supervise your children's learning.

You may not: Sell, redistribute, or commercially exploit worksheets or any MathMigo content. Share your account credentials outside your household. Create multiple accounts to abuse free trials or promotions. Upload content that is inappropriate, offensive, illegal, or unrelated to worksheet submissions. Attempt to hack, reverse engineer, or interfere with our systems, AI models, or security measures. Use automated tools (bots, scrapers) to access the service. Circumvent any access restrictions or usage limits.

Violation of these terms may result in immediate suspension or termination of your account without refund.

5. Content & Intellectual Property

Our Content: All worksheets, curriculum, software, AI models, graphics, logos, and other materials provided through MathMigo are owned by MathMigo LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use this content for personal, non-commercial household use only.

Your Content: You retain ownership of photos and images you upload for grading. By uploading content, you grant MathMigo a worldwide, royalty-free, non-exclusive license to: (a) process the content to provide grading services, (b) store the content as part of your account history, and (c) use anonymized, de-identified versions of submitted content to improve our AI grading accuracy and service quality.

We do not claim ownership of your uploaded photos. You may delete your uploaded content at any time through the app or by contacting support.

Feedback: If you provide suggestions, ideas, or feedback about MathMigo, you grant us the right to use that feedback without compensation or attribution. Do not share feedback if you do not want us to use it.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the service will be uninterrupted, error-free, or secure; (b) AI grading will be 100% accurate; (c) the service will meet your specific educational needs or goals; (d) any defects will be corrected; or (e) the service will be compatible with all devices.

You acknowledge that: (a) AI grading accuracy depends on photo quality, lighting, and handwriting legibility; (b) the service is supplemental and does not replace professional educational instruction; (c) educational outcomes vary by child and depend on many factors beyond our control.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATHMIGO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, DATA, OR GOODWILL; SERVICE INTERRUPTIONS; GRADING ERRORS; OR ANY OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless MathMigo LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the service.

We reserve the right to assume exclusive defense of any claim subject to indemnification. You agree to cooperate with our defense of such claims.

9. Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

Class Action Waiver: YOU AND MATHMIGO AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any class proceeding.

Exceptions: Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the service.

Opt-Out: You may opt out of arbitration by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, email, and a clear statement that you wish to opt out of arbitration.

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

10. Termination

By You: You may terminate your account at any time by deleting your account in the app settings or by contacting [email protected]. Your subscription will continue until the end of the current billing period.

By Us: We may suspend or terminate your account immediately if you violate these Terms. We may also terminate accounts that are inactive for extended periods (12+ months) after providing notice.

Effect of Termination: Upon termination, your right to use the service ends. We will delete your data according to our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive (including disclaimers, limitations of liability, indemnification, and dispute resolution).

11. General Terms

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MathMigo regarding the service and supersede all prior agreements.

Modifications: We may modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email. Your continued use after changes take effect constitutes acceptance. If you do not agree to modified terms, you must stop using the service.

Severability: If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure: We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
